These Terms of Service (“Terms”) govern the provision of services by Hollow Legs Media (“we”, “us”, or “our”) to our clients (“you”, “your”).
By engaging our services, you agree to the following:
Services
We provide social media management, content creation, photography, videography, and related marketing services as agreed in writing (e.g. proposal, email, or contract). The exact scope of work will be defined before work begins.
Fees and Payment
Services are provided on a monthly retainer or project basis, as agreed.
Invoices are generally issued in advance of each service period unless otherwise agreed. Payment is due upon receipt, and work will commence once payment has been received. Late payments may result in delays or suspension of services.
Additional services, project work or out-of-scope requests may be invoiced separately following completion of the work and are payable upon receipt. For project-based work, deposits may be required before work commences.
Term and Cancellation
For services operating on a monthly basis (such as Starter, Core, Growth or Premium packages), the agreement will renew automatically each month unless either party provides written notice prior to the next billing cycle.
Professional photography sessions included within the Premium package are generally provided approximately once every three (3) months of continuous Premium engagement. The scheduling and frequency of such photography sessions shall be determined by Hollow Legs Media based on content requirements, existing content libraries, operational considerations and the needs of the business.
Fees paid for the current service period are non-refundable once work has commenced.
Scope and Revisions
Our services include the deliverables outlined in your agreed scope. Requests outside of this scope may be subject to additional fees.
We aim to be flexible and collaborative, but excessive revisions or changes may incur additional charges.
Content Creation and Usage
We retain the right to use any content created for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
Where applicable, content created as part of an ongoing engagement may be delivered progressively and used within the agreed scope of services.
Upon full payment, you are granted a non-exclusive licence to use the final delivered content for your business.
Client Responsibilities
You agree to provide timely access to necessary information, materials, and approvals.
You also agree to ensure all information provided is accurate and does not infringe on third-party rights.
Delays in communication or approvals may impact timelines and results.
Performance and Results
We aim to deliver high-quality work and improve your online presence. However, we do not guarantee specific results, including follower growth, engagement levels, or revenue.
Social media performance can be influenced by many external factors beyond our control.
Third-Party Platforms
Our services may involve platforms such as Instagram, Facebook, and Google. We are not responsible for changes to these platforms, outages, or algorithm updates that may affect performance.
Limitation of Liability
To the fullest extent permitted by law, Hollow Legs Media shall not be liable for any indirect, incidental, or consequential losses arising from the use of our services.
Intellectual Property
All pre-existing materials, tools, and processes remain our property. Final deliverables may be used by you as outlined above.
Confidentiality
Both parties agree to keep confidential any sensitive or proprietary information shared during the course of the engagement.
Changes to Terms
We may update these Terms from time to time. The latest version will always be available upon request or on our website.
